Bolt Delivery Drivers Strike in Ukraine after 50% Wage Cut

Some 70 Bolt food delivery drivers in Ukraine are waging a digital strike after their wages were reduced by 50 percent, a move that built on the drivers’ discontent with lack of health coverage and cutbacks in bonus payments, a growing global phenomenon. The platform workers are turning off their apps each day at 2 p.m., making it difficult for the company to fulfill evening food orders.

“Transportation costs are the same, risks are the same, and money is half as much. It’s outrageous!” says Artem, a Bolt courier. Like many striking couriers, his backpack features a sticker supporting the strike.

Further cutting into drivers’ wages, he says, is the need to pay for constant bike or scooter repairs.

“For seven days of eight to ten hours of work, a courier covers more than 1,000 kilometers (622 miles) amid city traffic. Every day, you face potholes on the road, there is a constant need of repair, replacing some parts,” he says. “Income no longer covers risks.”

Bolt Founder a Billionaire, Workers Struggle for Pay

Although Bolt is a familiar brand in the United States for its green ride-sharing scooters scattered across urban areas, elsewhere in the world, the company rivals Uber as a delivery service, with 75 million customers in Africa and Europe, especially eastern Europe. In Ukraine, Bolt has 3.5 million customers served by fewer than 100 delivery drivers.

The company is valued at more than $2 billion, according to its Estonian founder Markus Willig, and raised $20 million in funding from the World Bank’s International Finance Corporation this year. With total fundraising at $596 million, the company seeks to expand further into Africa and plans to add markets in Latin America and Asia Pacific through franchising agreements.

Yet, even as Willig, 27, has become the third richest person in Estonia through Bolt profits, couriers who daily face dangerous conditions receive no income when they are injured and cannot work.

“You constantly hear about couriers getting into an accident, receiving medical treatment, having surgery,” says Artem. “If you suffer yourself, there must be a certain ‘cushion’ for you not to starve at least for the duration of treatment.”

Bolt workers in Ukraine are calling for a return to the previous bonus and payment structure, and pay for waiting at restaurants for orders. They also want health and life insurance and say the company should seek legislative measures to ensure scooters are registered.

Platform Workers Join Together to Demand Rights

Well before the COVID-19 pandemic boosted home delivery services, the demand for couriers and other essential workers was increasing around the world. But because they are classified as “independent contractors,” platform workers are ineligible for the same benefits as workers in the formal economy, and typically are not covered by a country’s labor laws.

Like Bolt workers in Ukraine, couriers from Nigeria to Colombia are joining together to demand their fundamental rights to decent work—living wages, social protections like health care, and measures to improve job safety.

Workers at Bolt’s Ukraine rival, the Spanish-owned Glovo, pushed for an increase in wages and paid insurance, revealing brutal working conditions in the process. Across Ukraine, unions are engaged in creative campaigns to reach gig economy workers, a campaign worker rights attorney George Sandul discusses in depth on The Solidarity Center Podcast.

In Colombia, Rappi platform delivery workers last year formed the Union of Platform Workers (UNIDAPP), to counter fluctuating pay rates for individual delivery jobs, unexplained fines levied by the company, and the arbitrary barring of workers from the platform to accept jobs.

Bolt workers in other countries are taking action as well. Earlier this year, the Independent Workers’ Union of Great Britain protested lack of safety for drivers following the murder of Bolt driver Gabriel Bringye. Research published by Oxford University in March found that Bolt and Amazon had the worst working conditions for gig economy workers in the UK.

In Tbilisi, Georgia, couriers at Bolt went on strike in March to protest lowered wages and what they say is a manipulated bonus system and unwarranted layoffs. Georgia couriers at Glovo also protested this past spring over lack of medical coverage for work-related injuries and changes to the app-based algorithm making it more difficult to get orders..

Bolt drivers in Lagos, Nigeria, part of the Professional E-hailing Drivers and Private Owners Association, went on strike in April to protest poor working conditions and pay. Bolt recently was forced to increase fares in Kenya after drivers in Nairobi threatened to strike over high fuel prices.

As Artem says, “We have to remind them that in a food delivery company, couriers are the ones who actually deliver, and without them the company does not exist.”

‘ALARMING’ ILLEGAL SURVEILLANCE OF UKRAINE UNION HEADQUARTERS

A hidden video-surveillance camera discovered on Monday was recording the entrance of the central office of the Confederation of Free Trade Unions of Ukraine (KVPU)—an act described by the organization as illegal and a possible attempt to interfere with trade union activity.

“The KVPU is deeply concerned about possible negative consequences for people, especially for activists and whistleblowers who visited our [Kyiv] office,” says KVPU Chairperson Mykhailo Volynets. Visiting diplomats and politicians may also have been illegally surveilled.

Describing the discovery as “alarming,” KVPU International Secretary Olesia Briazgunova says the organization is demanding a thorough police investigation and the opening of a criminal case.

“A lot of people come here to get legal assistance, discuss trade union activities or inform about corruption,” says Volynets, who fears for those helping KVPU prevent the adoption of draft laws that narrow worker rights in contradiction of international labor standards and those who are highlighting corruption in the coal industry and state-owned transport enterprises.

The recording of people without their consent, except in specific cases established by law, is prohibited by Article 307 of the Civil Code of Ukraine, says KVPU.

 

Worker Rights Experts Contribute to Ukraine Human Rights Strategy

Legal experts supported by Solidarity Center partner Labor Initiatives (LI), an organization representing and advancing worker rights in Ukraine, contributed recommendations that were incorporated into the country’s latest National Human Rights Strategy. The 2021–2023 strategy—a legally binding document to be implemented by state authorities in accordance with United Nations International Standards and Principals and Ukraine’s Association Agreement with the European Union—was signed into force by President Volodymyr Zelensky earlier this year.

Up to 100 action points are listed in the new strategy, including several advanced by LI lawyers Inna Kudinska, George Sandul, Katia Shvets and Nadia Yolkina in sections on freedom of association, worker rights, social protections, business and human rights, and anti-discrimination.

“The increasing significance of the LI team’s expertise is reinforcing its ability to make workers’ voices heard,” says Solidarity Center Ukraine Country Program Director Stanislaw Cieniuch.

Action points successfully advanced by LI to promote gender equality include: 1) Ratification of Convention 190, a new global International Labor Organization (ILO) treaty to prevent and address violence and harassment in the world of work that includes gender-based violence and harassment; 2) Amendment of the national labor code on equal pay and reduction of the gender pay gap; and 3) Development of national policies to shift the burden of proof in discrimination cases—including gender-based cases—from the employee to the employer.

LI’s lawyers also advanced action points for amending the country’s law on collective labor disputes, including ways to improve dispute resolution procedures and remove bureaucratic barriers preventing workers from exercising their right to strike.

“Labor is the defining part of life for every person,” reports LI. “[S]trong labor rights protections and rule of law are core safeguards to avoid catastrophic consequences for the people of Ukraine.”

Ukraine’s National Human Rights Strategy—first developed in cooperation with international organizations and civil society in 2015—is intended to develop a document that outlines citizens’ legal protections and to unite society around a common understanding of the value of human rights and freedoms to be protected equally and without discrimination.

Podcast: Making the Gig Economy Work for Workers

Like gig economy workers around the world, delivery drivers in Ukraine “have zero labor rights,” says worker rights attorney George Sandul. And, during the COVID-19 pandemic, “the drivers were on the front line of this struggle without any personal protective equipment, without any guarantees. And in case they will catch COVID, nobody will pay any compensation for them.”

Sandul spoke with Solidarity Center Executive Director Shawna Bader-Blau, host of The Solidarity Center Podcast, where he shared how unions in Ukraine are engaged in creative campaigns to reach these vulnerable workers. At the same, it is necessary to educate the public, he says.

“The first step to solve this problem is to raise awareness about this problem because, in fact, the ordinary customer perceives that the gig economy is something that simplifies his or her life.”

The future of work must not be one where employers do not take responsibility for their workers, Sandul says.

“To change the power balance, unions are the crucial for democracy development in Ukraine because without controlling the big corporations of the state, we will get dictatorship of the big companies.”

Ukraine Union Whistleblower Wins Appeal, Struggle Continues

In a boost for Ukraine’s anti-corruption efforts and worker rights, Olena Bebeshko, leader of the Independent Trade Union of Aviation Workers of Ukraine at the VIP terminal at Kyiv’s Boryspil International Airport, won a landmark legal victory last week. An appeals court affirmed a 2021 lower court decision that—under whistleblower-protection rules—Bebeshko had been illegally fired in retaliation for reporting widespread corruption at the terminal.

The court ordered immediate reinstatement, at full pay, and awarded her $5,300 compensation.

“This case is a milestone for labor rights protections and combating large scale corruption,” said Independent Aviation Workers Union of Ukraine President Veniamin Tymoshenko.

After reporting corruption at the terminal to Ukraine’s National Anticorruption Bureau, Bebeshko and other terminal workers suffered harassment and violent attacks. For example, a mother of two, Natalia Zhulinska, was fired after refusing to ignore improper activities and almost entirely blinded in a 2017 acid attack. Before that, her car was destroyed by fire, with explosives and weapons planted inside to frame her for the attempt on her life, says her union.

Bebeshko was fired in 2021 after directing corruption allegations from the union to the National Anticorruption Bureau. Although a lower court ordered that she be reinstated immediately, she was denied admittance to her workplace and her pay cut by one-third during the appeals process.

The court decision has advanced the country’s fight for whistleblower rights and against corruption.  Bebeshko is of one of very few workers to have won official whistleblower status in Ukraine, despite new legislation that provides whistleblowers with added protections, especially as applied to labor rights.

Transparency International in 2020 ranked Ukraine 122 out of 181 countries in relative degree of corruption.  The “Solidarity Against Corruptioncampaign—a broad alliance of civil society members including unions and Solidarity Center partner Labor Initiatives (LI)—aims to improve legal protections for workplace rights, whistleblowers and freedom of association in Ukraine.

Workers at the Boryspil airport VIP terminal began reporting rampant corruption in 2014 after new management took over following a change of government. Loyalists willing to engage in, or facilitate, corruption allegedly retained their jobs while 50 workers were laid off and their positions turned over to new managers’ friends and family. The goal, the union says, was to ensure that only those willing to ignore or support management skimming of airport funds—among other corrupt practices—worked the terminal. Terminal workers the following year organized and affiliated to the Ukrainian Independent Trade Union of Aviation Workers of Ukraine to collectively protect their jobs, and the public, from corrupt practices at the terminal.
