Report: Call to Action for Rights of People on the Move

The freedom to speak, join unions and take part in community life are basic human rights that apply to all people—including migrant workers and refugees, panelists at a United Nations side event said this afternoon in New York City.

“Migrant workers and refugees don’t usually have access to justice, and so the lack of enjoyment of these rights has more of a negative impact on them than on the general population,” said Felipe Gonzalez Morales, United Nations Special Rapporteur on the Human Rights of Migrants.

Gonzalez and other panelists took part in the event to launch a new report, Freedoms on the Move: The Civic Space of Migrant Workers and Refugees, by the Solidarity Center and CIVICUS. The report’s findings make clear that many migrant workers and refugees want to access their civic freedoms and do not want to remain on the margins. They want to have a say in their communities and their workplaces, and in the decisions that affect their lives.

Through in depth surveys, Freedoms on the Move highlights the experiences of 1,000 migrant workers and refugees in Germany, Kenya, Jordan, Malaysia and Mexico who discuss the barriers to freedom of association, assembly and expression, and the factors enabling them to exercise those rights.

“Legislation in countries deny migrant workers the right to have access to freedom of association,” said Griet Cattaert, policy officer at the International Labor Organization. And because migrant workers often work in the informal economy, sometimes in “hidden work” like domestic workers in private homes, “it is much more difficult to organize themselves in unions,” she said.

Freedoms on the Move: An Urgent Call to Action

The global assaults on democracy and fundamental rights is an urgent call to action for unions and other civil society groups to include migrant workers and refugees in advancing these rights, panelists said.

In the report, CIVICUS and the Solidarity Center urge all states to create and maintain, in law and in practice, an enabling environment for the rights of migrant workers and refugees, in accordance with international laws and standards.

“Democratic society cannot thrive when entire populations of people excluded,” said Neha Misra, Solidarity Center senior specialist for migration and trafficking. “Migrant workers we talked to rightfully insisted their destination countries have much to gain from their presence. Migrant worker rights are not just good for them but their communities.”

“Freedom of association and expression are important for migrant workers because they are human rights,” said Crispin Hernandez, a migrant agricultural worker who helped his co-workers organize with the Workers’ Center of Central New York.

“It doesn’t matter where we come from, or our country of origin, or our gender. At the end of the day, it doesn’t matter what kind of work you do. It doesn’t matter what I do for a living. I am entitled to my rights. We are humans.”

Freedom to Form Unions Key to Migrant Worker Rights 

More than 258 million migrants, 164 million of whom are migrant workers, live outside their origin countries as global inequality and the search for decent work push workers to migrate far from their homes, and as war and economic crises force millions across borders.


Monami Maulik, international coordinator at the Global Coalition on Migration, discussed how the report builds on the recently negotiated Global Compact on Safe, Orderly and Regular Migration, the first-ever UN global agreement on a common approach to international migration in all its dimensions.

“Fundamental to success of the Global Compact on Migration is the participation and engagement of migrant workers with unions and civil society, and so the success of implementing rights’ protections for migrant workers means we first must look at what’s happening to their freedom to organize,” she said.

Freedoms on the Move finds that “migrant workers and refugees must have the opportunity to come together, advocate for their well being without fear of reprisal and hold states accountable for delivering on their obligations under international laws,” Misra said.

Employer Harassment Major Barrier to Forming Unions

The report found that harassment or pressure from employers is the main obstacle for migrant workers seeking to form unions or otherwise exercise their freedom of association: 78 percent of respondents in Jordan, 66 percent in Kenya, 74 percent in Malaysia and 33 percent in Mexico.

More key findings from the report include:

  • Migrant workers believe the main limitation on their freedom of expression is the possibility of being fired from work, detained or deported, with wide variations by gender: 47 percent of women and 72 percent of men in Jordan; 62 percent and 71 percent respectively in Kenya; 50 percent and 41 percent in Malaysia, and 80 percent and 45 percent in Mexico.
  • Rates of participation in protests vary widely, from only 11 percent in Jordan and Mexico to 58 percent in Germany.
  • Refugees say a lack of resources is the major limitation that prevents people from associating and organizing.

As globalization and the search for decent work push workers to migrate far from their homes, and as war and economic crises force millions across borders, there is limited data on whether and how migrant workers and refugees are able to exercise their fundamental civic freedoms.

Through two in depth surveys, one of migrant workers and another of refugees, Freedoms on the Move also explores the factors that make migrant workers and refugees more likely to try to assert their rights, the circumstances that make them more vulnerable to violations and abuses, and the perpetrators and enablers of denials of their rights.

Freedoms on the Move is an urgent call to action for unions and civil society advocating for civic freedoms in their countries. As the report states:

“International human rights law does not limit civil and political rights to citizens. Like everyone else, migrant workers and refuges should be able to enjoy the key civic freedoms of association, peaceful assembly and expression. For migrant workers and refugees, these freedoms offer protection against discrimination, marginalization and scapegoating, which commonly affect them in their host or destination countries. When the rights to association, peaceful assembly and expression are open to migrant workers and refugees, they can organize and act to uphold their interests in their workplaces and communities, influence public opinion and hold public officials accountable.”

As a migrant mine worker from Swaziland, Mduduzi Thabethe says he has fewer workplace rights than his South African co-workers. Although all mine workers pay the same amount into the health fund, migrant workers get inferior care and pensions are rare.

“If you are a citizen of South Africa, you see you are building your country and you have something, but we have nothing.”

Although media and policymakers focus on African migrants to Europe, some 80 percent of African migrant workers remain on the continent.

Thabethe’s union, the Association of Mineworkers and Construction Union, is among those working to improve conditions for migrant workers.

The Kuwait Trade Union Federation (KTUF) this week celebrated the relaunch of a migrant worker office within its headquarters to help address legal cases related to wage theft or other forms of exploitation brought by migrant workers, including domestic workers, in the country. Two-thirds of Kuwait’s 4.5 million residents are migrant workers, including approximately 660,000 domestic workers.

Millions of migrant workers are trapped in conditions of forced labor and human trafficking around the world, in part as a result of being lied to by labor brokers about the wages and working conditions they should expect. Of the estimated 150 million migrant workers globally, some 67 million labor as domestic workers—83 percent of whom are women—often in isolation and at risk of exploitation and abuse. An International Labor Organization global standard—Convention189 on Domestic Workers—was adopted in June 2011 to protect domestic worker rights.

Domestic worker volunteers from Sandigan-Kuwait, a domestic worker rights organization for Filipino workers, and GEFONT Support Group-Kuwait, an organization for Nepali workers in Kuwait associated with the General Federation of Nepali Trade Unions (GEFONT), will staff the office, encouraging workers to drop in or call to report abuse and request legal assistance from KTUF.

“Nepali laborers abroad have been facing constant suffering, while legal and social rights are not implemented,” says GEFONT Support Group-Kuwait President Ganesh Rawat.

This is the first time that migrant organization volunteers have been invited to participate in the operations of KTUF’s migrant worker office. With support from the Solidarity Center, KTUF will be able to increase its assistance with migrant worker-initiated legal cases.

“The migrant workers’ office opens its doors to all representatives of migrant worker communities, in all categories, to receive complaints,” says KTUF Assistant Secretary General Obeid Menahi Al Ajmi. The federation, he continues, will devote all its resources and tools to support migrant workers, in coordination with the country’s domestic worker department.

The project can be “the avenue on helping each other for the betterment of everyone,” says Sandigan-Kuwait, volunteer organizer, Chito Neri.

Kuwait has been recognized for some important progress on migrant worker issues. A new domestic worker law adopted in 2015, the first in the Gulf Cooperation Council (GCC) region, brought the country closer to compliance with internationally recognized labor standards and included a minimum wage and a maximum 12-hour workday, with one day off per week, for migrant workers such as maids, babysitters, cooks and drivers. Kuwait and the Philippines last year signed a new deal that prohibits common employment practices for migrant workers in the Gulf region, including confiscation of passports by employers.

However, migrant workers remain vulnerable to abuse. Changes to employment conditions may be rejected by private employers, who have a financial incentive for maintaining the status quo. A 2017 International Labor Organization study revealed that a significant percentage of employers in Kuwait took steps to prevent their domestic worker from leaving their employ by denying her a day off, refusing to allow her to leave the house unaccompanied or confiscating her passport—all indicators of forced labor. Domestic workers in Kuwait are not yet allowed to join unions to protect their rights.

Given ongoing challenges, unions say that protection of migrant worker rights requires cross-border, collective action. KTUF last month signed a cooperative agreement in Kuwait City with the Central Organization of Trade Unions-Kenya (COTU-K), formalizing the federations’ effort to jointly address issues affecting workers who migrate from Kenya to Kuwait. KTUF signed a cooperation agreement with the Nepalese Workers’ Union in April last year, committing to joint action in support of worker rights.

The KTUF is an important actor at the national policy level, maintaining a vigorous presence in deliberations on proposed labor law reform, economic restructuring, trade union rights and democratic freedoms. The Solidarity Center supports Kuwaiti unions’ active role in cross-regional collaborations, as well as capacity building programs for Kuwait Trade Union Federation (KTUF) affiliates in the civil service and oil sectors.

“Migrant workers are among the most vulnerable and abused workers in every country,” says Kaewleklai. “Worker rights are human rights, and migrant workers are entitled to fundamental rights without discrimination, including the freedom of association and collective bargaining. We will fight shoulder to shoulder with our sisters and brothers.”

Kaewleklai received the award during an NHRCT seminar last week, held in conjunction with International Women’s Day to honor women human rights defenders. The nonprofit MWRN, a Solidarity Center partner, has provided a crucial bridge between workers and access to legal redress for unpaid wages, occupational injuries and other forms of workplace abuse since it was founded in 2009.

“Whether they are protecting rights in the judicial process, fighting against impunity for rights violations, protecting democratic freedoms and the rights of communities and migrant workers, or fighting for freedom of expression, equality and the reduction of gender biases, their courageous stories are models and inspirations for future generations to learn and remember,” Angkana Neelapaijit, National Human Rights commissioner, said during the award ceremony.

Risking Physical, Verbal Assaults to Support Workers

Kaewleklai, a long-time trade unionist, began championing worker rights in the 1990s, when she worked at a factory in the Rangsit district, north of Bangkok. A co-founder of the factory’s union, she and other workers successfully challenged their employer’s refusal to regularly pay wages, and she successfully took legal action after the employer fired her and other union activists.

She later worked as coordinator for the Thai Labor Solidarity Committee, another Solidarity Center partner, and has championed the issues of working women, successfully campaigning to make International Women’s Day a national holiday.

At the MWRN, Kaewleklai advocates for the rights of migrant workers to form unions, negotiate with their employers for better working conditions, and urging lawmakers to ratify International Labor Organization standards on freedom of association and collective bargaining. She has helped migrant workers on chicken farms and elsewhere recover unpaid wages and attain safe working conditions.

She repeatedly has been verbally threatened, physically attacked and put under surveillance by state and non-state actors for her work to protect and promote labor rights and the rights of migrant workers. Currently, Kaewleklai, along with 14 migrant workers and other human rights defenders, is challenging criminal and civil charges filed by the poultry company, Thammakaset Company, following her advocacy on behalf of the company’s underpaid migrant workers.

Despite rulings by authorities and the courts against Thammakaset—including a January Supreme Court decision upholding a lower court ruling ordering Thammakaset to pay $53,600 to 14 former migrant workers for violations of the Labor Protection Act—the company continues to pursue charges against Kaewleklai and the others. Human rights defenders believe the charges are part of a strategy to harass human rights defenders and migrant worker rights advocates.
